Statute of the Council for cooperation of local self-government bodies at the Council of the Republic of the National Assembly of the Republic of Belarus

General provisions

1. The Council for cooperation of local self-government bodies at the Council of the Republic of the National Assembly of the Republic of Belarus (hereafter — the Council) is a collegial consultative body working out proposals as to the improvement of the activity of local self-government bodies and coordinating interaction between them and state government bodies.
2. The Council in its activity shall be guided by the Constitution of the Republic of Belarus, laws of the Republic of Belarus, ordinances, decrees and orders by the President of the Republic of Belarus, resolutions of the Council of the Republic of the National Assembly of the Republic of Belarus, the given Statute and other regulatory legal acts.
3. The Statute of the Council for cooperation of local self-government bodies at the Council of the Republic of the National Assembly of the Republic of Belarus is approved by a Resolution of the Council of the Republic of the National Assembly of the Republic of Belarus.

Primary targets of the Council

4. The Council shall have the following targets:

explanation and propaganda of the state policy in the field of local self-government;
elaboration of recommendations and suggestions related to the formulation and implementation of state policy on local self-government, in particular in defining major prospects for the improvement of the legislation of the Republic of Belarus in the area concerned;
coordination of cooperation among the Council of the Republic of the National Assembly of the Republic of Belarus (hereafter — the Council of the Republic), local self-government bodies and state government bodies;
contribution to ensuring a balanced approach to serve both state and local interests in the process of elaboration and implementation of social and economic programmes;
encouragement of professional development of chairpersons and other officials of local Councils of Deputies.

Major functions of the Council

5. In compliance with the primary targets stated in paragraph 4 of the given Statute, the Council shall carry out the following functions:

studying the situation at a local level, analysis and synthesis of problems, working out recommendations and suggestions regarding improvement of the major activity areas of local self-government bodies, assistance with dissemination of good practice;
considering most important drafts of regulatory legal acts in the field of legal relationship of local self-government institution and working out suggestions as to further improvement of the legislation in this sphere;
interaction with local self-government bodies, trade union, youth, veterans and other public associations, scientific and other organizations both in the Republic of Belarus and abroad on the matters concerning the execution of local self-government;
forecasting possible results of the state bodies’ decisions follow up with regard to local self-government issues and producing relevant recommendations;
informing state government bodies on most serious problems of the life of the population and assisting with finding a solution;
providing a “feedback” from local Councils of Deputies of primary and base territorial levels, including arrangement of meetings, seminars, “round tables”, with their representatives involved;
taking measures aimed at upgrading professional qualifications of chairpersons and other officials of the Councils of Deputies;
fulfilling other functions arising out of the targets of the Council.

Composition and structure of the Council

6. The Council shall consist of the Chairperson of the Council, Deputy Chairperson of the Council and members of the Council.
7. The Chairperson of the Council shall be ex officio the Chairperson of the Council of the Republic.
8. Suggestions on the Council’s composition including the candidacy of the Deputy Chairperson of the Council shall be introduced before the Council of the Republic by its Presidium. Candidacies, proposed to the Council from a Province or Minsk City shall be preliminarily agreed with the relevant presidium of the Province Council of Deputies (Minsk City Council of Deputies).
9. The Chairperson of the Council, the Deputy Chairperson of the Council and members of the Council shall work on a voluntary basis. Rotation of the Council members shall be carried out as needed.
10. The Executive Secretary of the Council shall be ex officio the Head of the Department for interaction with local self-government bodies of the Secretariat of the Council of the Republic.
The Executive Secretary of the Council shall be a member of the Council.
11. The composition of the Council shall be approved by the resolution of the Council of the Republic.

Organizing the activities of the Council

12. The Chairperson of the Council shall arrange and coordinate the activities of the Council.
13. Sittings of the Council shall be conducted as needed, but as a rule no less than once per quarter.
14. A sitting of the Council shall be a quorum if the number of those present is more than a half of the total number of the Council members.
15. The work of the Council shall be carried out in accordance with annual plans approved at its sittings.
16. Decisions of the Council shall be made by open vote with simple majority and also by questioning. In case of equity of votes the vote of the Chairperson of the Council shall be a casting one.
17. Decisions of the Council shall be formalised with a protocol signed by either the Chairperson of the Council or an official presiding at the sitting. The decisions of the Council shall be non-binding.
18. In the absence of the Chairperson of the Council his/her functions shall be performed by the Deputy Chairperson of the Council.
19. The members of the Council shall be entitled to:

participate in all activities undertaken by the Council;
put forward proposals relating to the plan of action of the Council, agendas of its sittings and issues under consideration within the competence of the Council;
participate in the preparation of draft decisions and documentation for the Council sittings and other activities undertaken by the Council;
have access to the documentation on the work of the Council.

20. The Executive Secretary of the Council shall perform the following functions:

to ensure the preparation of agendas for the sittings of the Council and annual plans for its work;
to organise and ensure the preparation of decision drafts and documentation for the Council sittings;
to inform the Council members on the venue, time and agenda of regular sittings of the Council;
to organise taking of minutes of the Council sittings;
to inquire about materials necessary for the work of the Council from departments and divisions of the Secretariat of the Council of the Republic;
to ensure the control of execution of the decisions made by the Council.

21. Representatives of state bodies, organisations and the mass media, scientists and specialists may be involved to study the issues within the competence of the Council. Besides, working groups under the direction of one of the Council members shall be established for this purpose.
22. The Secretariat of the Council of the Republic shall provide analytical and informational, organizational and legal, material and technical as well as financial support for the activities of the Council.
